Terms of Service

1. Acceptance of Terms

By registering, accessing, or using ZeroView (the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

These Terms apply to all users — individuals, businesses, and organisations. Use of the Service on behalf of an organisation means the organisation also accepts these Terms.

2. Definitions

Term	Meaning
"Service"	The ZeroView platform, including all software, dashboards, APIs, and related tools.
"Account"	A registered profile granting you access to the Service.
"Subscription"	A paid plan granting defined access to Service features.
"User Data"	All survey responses, content, and datasets you collect or upload via the Service.
"Respondent"	Any individual who completes a survey created using ZeroView.

3. Eligibility & Registration

You must be at least 18 years old and legally capable of entering into a binding contract to use ZeroView. By registering, you confirm all information provided is accurate and current.

• You are responsible for keeping your account credentials secure and confidential.
• Notify us immediately of any unauthorised account access at sales@cnxdatalab.com.
• You may not share or transfer account access to third parties without our written consent.

4. License & Access

Subject to these Terms and timely payment of fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business or personal purposes.

You may not:

• Sublicense, sell, resell, or transfer access to the Service to any third party
• Reverse engineer, decompile, or extract source code from any part of the Service
• Modify, copy, or create derivative works based on the Service
• Remove or obscure any ZeroView or CNX branding or proprietary notices
• Use automated tools (bots, scrapers) to access or extract data from the Service
• Use the Service to benchmark or build a competing product

5. Subscription & Billing

Plans & Fees

ZeroView offers subscription plans with defined features and response limits. View current pricing and available promo codes on our Pricing page. We may update pricing with 30 days' advance notice to existing subscribers.

Billing

• Subscriptions are billed in advance — monthly, quarterly, half-yearly, or annually as per your selected plan.
• You will receive a detailed invoice upon confirmation showing the scope, fees, and applicable taxes.
• All fees are exclusive of GST unless stated otherwise. 18% GST will be added as required under Indian tax law.
• You are responsible for maintaining accurate and current billing information.

Payment Processing

Payments are processed via trusted third-party gateways. CNX does not store or handle payment card data directly. All transactions are governed by the payment processor's own security standards.

Late Payments

Invoices unpaid beyond the due date may result in a late fee and/or temporary suspension of your account until cleared. Persistent non-payment may lead to permanent termination and, where applicable, debt recovery proceedings.

Auto-Renewal

Subscriptions renew automatically at the end of each billing period. You may cancel auto-renewal at any time from your account dashboard before the renewal date. Failure to cancel before renewal constitutes acceptance of the next billing cycle.

6. Data Ownership & Privacy

• You are solely responsible for the legality, accuracy, and ethics of the data you collect.
• You must obtain all necessary consents from respondents before collecting personal data.
• You must comply with applicable data protection laws including India's DPDPA 2023 and, where applicable, the GDPR.
• You must not collect sensitive personal data without explicit consent and appropriate safeguards.

You may export your User Data at any time via the dashboard. Upon account termination, data is retained for 60 days to allow export, then permanently deleted. See our Privacy Policy for full details.

7. Acceptable Use

You must use ZeroView only for lawful purposes. You must not use the Service to:

• Violate any applicable law or regulation
• Collect data from minors under 18 without verifiable parental consent
• Create or distribute misleading, deceptive, defamatory, or harassing surveys
• Engage in spam, phishing, or unsolicited mass communications
• Interfere with, overburden, or disrupt the Service's infrastructure
• Attempt unauthorised access to the Service or any other user's account
• Upload or distribute malware, viruses, or any harmful code
• Use the platform for unlawful surveillance or discriminatory profiling

8. Security

ZeroView implements industry-standard security including AES-256 encryption at rest and in transit (TLS 1.2+), role-based access controls, regular security assessments, and secure data centres. No system is 100% secure; you use the Service at your own risk. In the event of a data breach affecting your data, we will notify you within 72 hours as required by law.

9. Suspension & Termination

Cancellation by You

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing cycle. No refund is issued for the remaining period.

Termination by CNX

We may suspend or permanently terminate your account, with or without notice, if you breach these Terms, fail to pay fees within 14 days of the due date, engage in fraudulent or illegal activity, or pose a security risk to CNX or other users. On termination, your access ceases immediately; User Data is available for export for 60 days thereafter.

10. Limitation of Liability

To the maximum extent permitted by law, CNX shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total aggregate liability for all claims shall not exceed the total fees paid by you in the 12 months preceding the claim.

You agree to indemnify and hold harmless CNX, its officers, directors, and employees from any claims or expenses arising from your breach of these Terms, your use of the Service, or your User Data.

11. Intellectual Property

All software, designs, trademarks, logos, and content comprising the ZeroView platform are the exclusive property of CNX Datalab Private Limited and are protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you. You grant CNX a limited, royalty-free licence to host and process your User Data solely to deliver the Service.

12. Governing Law

These Terms are governed by the laws of India. Both parties agree to attempt good-faith resolution by contacting sales@cnxdatalab.com before initiating formal proceedings. If unresolved within 30 days, disputes shall be settled by binding arbitration under the Arbitration and Conciliation Act, 1996 (India). Where arbitration is inapplicable, disputes are subject to the exclusive jurisdiction of the courts of India.

13. Changes to Terms

We may update these Terms at any time. For material changes, we will provide at least 14 days' advance notice via email or in-platform notification. Continued use of the Service after changes take effect constitutes acceptance.
